Consent to SMS Account Notifications Agreement

Before you use our SMS Account Notifications you must review and consent to the terms outlined below.

In this Consent Agreement:

“We,” “us,” “our” and “emBorrow” means emBorrow LLC, and each and every current and future affiliate of emBorrow LLC. “You” and “your” means the person giving this consent, and also each additional account owner, co-signer, authorized signer, authorized representative, and/or service user identified on any emBorrow Product that you apply for, use or access.
“Notifications” means each disclosure, notice, alert, agreement, fee schedule, statement, record, document, and other information we provide to you, or that you sign or submit or agree to at our request. “emBorrow Product” means each and every loan, account, product or service we offer that you apply for, own, use, administer or access, either now or in the future. emBorrow Products include SMS Account Notifications. The words “include” and “including,” when used at the beginning of a list of one or more items, indicates that the list contains examples – the list is not exclusive or exhaustive, and the items in the list are only illustrations. They are not the only possible items that could appear in the list.

When consenting to messaging notifications, you authorize emBorrow, our assigns, successors or servicing agents to send SMS Notifications (as defined below) to any phone number provided to us, our assigns, successors or service agents in connection with this financing and any modification or renewal of this financing. As used in this text messaging disclosure, “SMS Account Notifications” means any SMS (text message) communications from us to you pertaining to your account or financing transaction sent to the phone number provided in connection with this transaction, including but not limited to application processing status, account information, payment information, due dates, delinquent accounts, and program updates.

How to Unsubscribe: You may withdraw your consent to receive SMS Account Notifications by replying with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT or calling us at 1-866-3-EMBRYO (36-2796). We may treat your provision of an invalid mobile phone number, or the subsequent malfunction of a previously valid mobile phone number, as a withdrawal of your consent to receive SMS Account Notifications. Any withdrawal of your consent to use SMS Account Notifications will be effective only after we have a reasonable period of time to process your withdrawal.

In order to access, view, and retain SMS Account Notifications that we make available to you, you must have: (i) a SMS-capable mobile phone, (ii) an active mobile phone account with a communication service provider; and (iii) sufficient storage capacity on your mobile phone.
All SMS Account Notifications in electronic format from us to you will be considered “in writing.”
There is no service fee for SMS Account Notifications. But you are responsible for any and all charges, including but not limited to fees associated with text messaging, imposed by your communications service provider. Please consult your mobile service carrier’s pricing plan to determine the charges for sending and receiving text messages. These charges will appear on your phone bill. Message frequency depends on account status or settings. We may modify or terminate our text messaging services from time to time, for any reason, and without notice, including the right to terminate text messaging with or without notice, without liability to you.

Terms and Conditions Apply. emBorrow provides installment financing only to residents of states where the company has a lending license. In order to apply for financing, you must submit your application online and have, among other things, verifiable income. You may also need to be a patient of a fertility clinic. The actual amount and terms of financing that a customer qualifies for may vary based on credit determination and state law. In some instances, we might not manage to check your application information completely and may request some additional documentation. Please thoroughly review our Consents, Disclosures, Rates, and Terms & Conditions for further information. Complete disclosures of APR, details and payment terms are included in the Financing Agreement.

Funds are generally deposited via ACH for delivery next business day if approved by 4:30pm CT Monday-Friday.

emBorrow reserves the right to modify or discontinue products and benefits at any time without notice.
Important disclosures and consumer notice: Financing from emBorrow is designed to help you meet your fertility related borrowing needs. This service is not intended to provide a solution for all credit or other financial needs. We will never charge you any “hidden fees” that are not fully disclosed in the Financing Agreement. Since we may report your payment history to one or more credit bureaus, late or non-payment of your account may negatively impact your credit rating. If you don’t make a payment in accordance with your financing terms, we will attempt to contact you via one or more authorized methods. Our company’s methods are in accordance with the guidelines of the Federal Debt Collections Practices Act (FDCPA). Be sure you thoroughly understand the terms and conditions of your financing before signing your agreement. We are here to serve our customers and their financial needs if possible.
